Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Cobble mobile application ("the App") operated by Cobble ("we", "us", "our"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the App.

2. Eligibility

You must be at least 18 years of age to use Cobble. By using the App, you represent and warrant that you are at least 18 years old and are legally permitted to participate in competitive gaming with cryptocurrency wagering in your jurisdiction. It is your responsibility to ensure compliance with your local laws.

3. Account Responsibility

You are solely responsible for:

• Maintaining the security of your wallet private keys and seed phrases
• All activity that occurs under your account or wallet address
• Ensuring your device and wallet software are secure and up to date

Cobble is not responsible for unauthorized access to your account resulting from your failure to secure your credentials. We cannot recover lost wallet keys or reverse blockchain transactions.

4. Wagered Gameplay

Cobble offers optional wagered gameplay where players can stake cryptocurrency (SOL and SPL tokens) on match outcomes. By participating in wagered games, you acknowledge and accept:

• Financial Risk: Real cryptocurrency is at stake. You may lose your entire wager. Only wager amounts you can afford to lose.
• No Guarantee of Winnings: Cobble does not guarantee any particular match outcome, payout, or return on wagers.
• Platform Fee: A 10% fee is applied to all payouts. This fee is deducted from winnings before settlement.
• Blockchain Finality: All wager transactions are processed on the Solana blockchain and are final once confirmed. Transactions cannot be reversed.
• Network Conditions: Blockchain network congestion, fee spikes, or outages may affect transaction processing. Cobble is not liable for delays or failures caused by network conditions.

5. Prohibited Conduct

The following activities are strictly prohibited and may result in immediate account suspension or termination:

• Bots, Scripts, and Automation: Use of any automated tools, bots, macros, or scripts to play games or interact with the App
• Multi-Accounting: Operating more than one account to gain an unfair advantage
• Collusion: Coordinating with other players to manipulate match outcomes or game results
• VPN Usage During Wagered Play: Using VPNs, proxies, or similar tools to circumvent geographic restrictions during wagered gameplay
• Exploiting Bugs: Knowingly exploiting software bugs, glitches, or vulnerabilities rather than reporting them
• Fraudulent Transactions: Submitting fake, forged, or manipulated transaction IDs
• Harassment: Engaging in abusive, threatening, or harassing behavior toward other players

6. Intellectual Property

The Cobble name, logo, game designs, visual assets, and proprietary code are the intellectual property of Nicholas Brickhouse and Cobble. You may not copy, modify, distribute, or create derivative works from any proprietary Cobble content without prior written permission.

7. Account Suspension and Termination

Cobble reserves the right to suspend, restrict, or permanently terminate any account at its sole discretion for:

• Violations of these Terms
• Suspected fraudulent or abusive activity
• Behavior deemed harmful to the platform, its users, or its integrity
• Legal or regulatory requirements

In the event of termination for cause, any pending wagers may be forfeited.

8. Limitation of Liability

To the maximum extent permitted by law, Cobble and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of cryptocurrency or digital assets
• Blockchain transaction failures or delays
• Wallet compromises or unauthorized access
• Loss of data or profits
• Service interruptions or downtime

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Dispute Resolution

Any disputes arising from or relating to the use of Cobble shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in class-action lawsuits or class-wide arbitration. Arbitration shall take place in the United States.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

11. Modification of Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted within the App and on our website. Your continued use of the App after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
